Direcciones IP
Los servidores del sitio web pueden detectar automáticamente la dirección IP y el nombre de dominio utilizados por el usuario. Una dirección IP es un número asignado automáticamente a una computadora cuando se conecta a Internet. Toda esta información se registra en un registro del sistema en el servidor que permite el posterior procesamiento de los datos para obtener solo mediciones estadísticas que nos muestran el número de visitas a la página, el número de visitas realizadas a los servidores web, el orden de las visitas, el punto de acceso, etc.
4. LEY APLICABLE Y JURISDICCIÓN
Estas condiciones se regirán por la ley española en todos los asuntos no expresamente establecidos. El PROVEEDOR y el USUARIO acuerdan someter cualquier disputa que pueda surgir de la prestación de los productos o servicios sujetos a estas Condiciones a los tribunales del domicilio del USUARIO.
En caso de que el USUARIO tenga su domicilio fuera de España, el PROVEEDOR y el USUARIO renuncian expresamente a cualquier otro foro, sometiéndose al Organismo de Resolución de Disputas que actuará como intermediario entre ellos de acuerdo con el Art. 14.1 del Reglamento (UE) 524/2013, sin necesidad de recurrir a los tribunales. En caso de que el USUARIO tenga su domicilio fuera de la Unión Europea, el PROVEEDOR y el USUARIO renuncian expresamente a cualquier otro foro, sometiéndose a cualquier Organismo de Resolución de Disputas que el PROVEEDOR comunique en el momento de recibir la reclamación, sin necesidad de recurrir a los tribunales de justicia
Política de privacidad
1. INFORMACIÓN PARA EL USUARIO
¿Quién es el responsable del tratamiento de sus datos personales?
SETESCA BCN, S.L. es el Responsable del Tratamiento de los datos personales del USUARIO y le informa que dichos datos serán tratados de conformidad con lo establecido en el Reglamento (UE) 2016/679, de 27 de abril (GDPR) y la Ley Orgánica 3/2018, de 5 de diciembre (LOPDGDD).
¿Con qué fin tratamos sus datos personales y por qué lo hacemos?
Dependiendo del formulario del que hayamos obtenido los datos personales, los trataremos confidencialmente para los siguientes fines:
RECOPILACIÓN DE PERFILES
Finalidades y legitimación del tratamiento: llevar a cabo un proceso de elaboración de perfiles con el consentimiento del Titular, basado en un tratamiento automatizado, dirigido a evaluar los aspectos personales especificados en el CV facilitado por el Titular para incluirlos en los procesos de selección de personal de empresas externas designadas por el Responsable.
Consecuencias previstas: el tratamiento de los datos no prevé consecuencias que puedan tener efectos jurídicos o de otro tipo que puedan afectar significativamente al Titular de los datos.
Lógica aplicada: para el tratamiento de los datos se utiliza un procedimiento automatizado en el que se filtran todos los campos con el fin de obtener un resultado lo más parecido posible al solicitado por las empresas que participan en la selección de candidatos.
Actualización de datos: en caso de modificación de sus datos, actualícelos inmediatamente utilizando los procedimientos previstos a tal efecto.
Criterios de conservación de los datos: los datos se conservarán durante un periodo máximo de un año desde su última actualización. En este sentido, transcurrido este plazo sin actualizar los datos, la información será bloqueada de tal forma que no estará disponible para las empresas. Transcurridos tres años sin actualizar la información, los datos serán borrados, garantizando el total respeto a la confidencialidad tanto en el tratamiento como en su posterior destrucción.
Comunicación de los datos: Los datos podrán ser comunicados a empresas externas afiliadas al Responsable del Tratamiento con el fin de ejecutar el contrato de trabajo y los cursos de formación necesarios para ello, o por motivos legales.
SERVICIOS
Finalidades y legitimación del tratamiento: prestación de los servicios solicitados (por ser necesario para la ejecución del contrato que implica dichos servicios, art. 6.1.b GDPR) y envío de comunicaciones relativas a productos o servicios (con el consentimiento del Interesado, art. 6.1.a GDPR).
Criterios de conservación de los datos: los datos se conservarán durante un plazo no superior al necesario para el mantenimiento de la finalidad del tratamiento o mientras existan prescripciones legales que impongan su custodia, y cuando dicha finalidad deje de ser necesaria se procederá a su supresión con las medidas de seguridad adecuadas para garantizar la anonimización de los datos o su destrucción total.
Divulgación de datos: los datos no se divulgarán a terceros, salvo obligación legal o que sea necesario para la prestación del servicio.
Transferencias transfronterizas de datos
Comunicación de los datos: los datos pueden comunicarse a terceros para cumplir la finalidad del tratamiento, o por motivos legales.
Transferencias internacionales de datos: de conformidad con lo dispuesto en el artículo 44 del RGPD, la autorización para la transferencia internacional de datos a un país que no haya sido declarado con un nivel de protección adecuado sólo podrá concederse si se obtienen garantías suficientes. Por lo tanto, podrá concederse si el responsable del tratamiento proporciona un contrato escrito, celebrado entre el exportador de datos y el importador de datos, en el que se establezcan las garantías necesarias con respecto a la protección de la privacidad del interesado y sus derechos y libertades fundamentales y se garantice la capacidad de ejercer sus respectivos derechos.
Riesgos del tratamiento: Declaro que he sido informado sobre la transferencia de datos al proveedor de los servicios descritos (según el contrato adjunto) y que se me ha informado claramente de los riesgos del tratamiento debido a la ausencia de garantías adecuadas para la protección de datos personales existentes en el país receptor.
¿Durante cuánto tiempo conservaremos sus datos personales?
Los datos se conservarán durante un plazo no superior al necesario para mantener la finalidad del tratamiento o mientras existan prescripciones legales que impongan su custodia, y cuando dicha finalidad deje de ser necesaria los datos se suprimirán con las medidas de seguridad adecuadas para garantizar la anonimización de los datos o su destrucción total.
¿A quién revelamos sus datos personales?
No está prevista la comunicación de datos personales a terceros salvo, en caso de ser necesario para el desarrollo y ejecución de las finalidades del tratamiento, a nuestros proveedores de servicios relacionados con las comunicaciones, con los que el RESPONSABLE haya suscrito los contratos de confidencialidad y encargado del tratamiento exigidos por la normativa vigente en materia de privacidad.
¿Cuáles son sus derechos?
Los derechos del USUARIO son:
* Derecho a retirar el consentimiento en cualquier momento.
* Derecho de acceso, rectificación, portabilidad y supresión de sus datos, así como la limitación u oposición a su tratamiento.
* Derecho a presentar una reclamación ante la Autoridad de Control española (www.aepd.es) si considera que el tratamiento no se ajusta a la legislación vigente.

2. CARÁCTER OBLIGATORIO O FACULTATIVO DE LA INFORMACIÓN FACILITADA POR EL USUARIO
Los USUARIOS, mediante la marcación de las casillas correspondientes y la introducción de datos en los campos, marcados con un asterisco (*) en el formulario de contacto o formularios de descarga, aceptan expresamente y de forma libre e inequívoca que sus datos son necesarios para que el proveedor pueda atender su solicitud, facilitando voluntariamente sus datos en los campos restantes. El USUARIO garantiza que los datos personales facilitados al RESPONSABLE son veraces y se hace responsable de comunicar al mismo cualquier modificación de los mismos.
El RESPONSABLE informa que todos los datos solicitados a través del sitio web son obligatorios, ya que son necesarios para la prestación de un servicio óptimo al USUARIO. En caso de que no sean facilitados todos los datos, no se garantiza que la información y servicios facilitados sean completamente ajustados a las necesidades del Usuario.
3. MEDIDAS DE SEGURIDAD
Que de conformidad con lo dispuesto en la normativa vigente en materia de protección de datos de carácter personal, el RESPONSABLE está cumpliendo con todo lo dispuesto en el GDPR y en la normativa LOPDGDD para el tratamiento de los datos personales de los que es responsable, y está cumpliendo manifiestamente con los principios descritos en el artículo 5 del GDPR, por los que son tratados de manera lícita, leal y transparente en relación con el interesado y adecuados, pertinentes y limitados a lo necesario en relación con los fines para los que son tratados.
El RESPONSABLE garantiza que se han implementado todas las políticas técnicas y organizativas apropiadas para aplicar las medidas de seguridad establecidas por el GDPR y la LOPDGDD con el fin de proteger los derechos y libertades de los USUARIOS, y les ha comunicado la información adecuada para que puedan ejercer sus derechos y libertades.
